GENERAL TERMS & CONDITIONS
1.1 These general terms and conditions (“GTC”) shall apply to all offers, legal relationships and agreements (“Agreement”) under which MDV Europe B.V. (“MDV”) provides products (“Products”) or services of whatever nature to the customer (“Customer”). Deviations from and additions to these GTC shall only be valid if they have been expressly agreed in writing.
1.2 The applicability of Customer’s purchasing and/or other general terms and conditions is explicitly rejected unless agreed otherwise in writing in the Agreement.
1.3 By submitting a purchase Order (“Order”) Customer accepts the applicability of these GTC. After receipt of the Customer’s purchase order.
1.4 If a Customer is in default with its payment obligations towards MDV, MDV may at any time reject and/or cancel the Agreement before delivery or put on hold the delivery, without any liability of MDV for any damages or costs.
1.5 The delivered Products shall be deemed to have been accepted by the Customer, unless MDV receives a notice of defects and/or shortages within seven working days after delivery. If Customer fails to notify MDV in writing within these seven working days, Customer loses his right to make any claim regarding defects, and/or shortages.
1.6 If a notice as set forth in clause 1.14 of these GTC has been timely sent by Customer, MDV may demand that: (i) the Customer will either return the defected Product for inspection or (ii) the Customer will send clear photographs of the defected Products.
1.7 If MDV accepts any claim regarding defects, shortages or surpluses of Products, MDV is entitled to replace and/or credit payment of the respective Products. In case of any surplus MDV may demand that the respective Products are returned. MDV shall be fully discharged from any and all liability towards Customer when the Products are replaced or payment has been credited.
1.8 If the Customer does not pay any invoice of MDV in a timely manner as agreed between MDV and the Customer, the Customer is automatically in default, without a notification being required. If the Customer fails to pay the invoice when due, MDV shall charge the statutory legal interest as set forth in article 6:119a Dutch Civil Code over the outstanding amount.
1.9 All Products delivered to the Customer shall remain MDV’s property until all amounts owed by the Customer for the Products delivered or to be delivered under any Agreement(s), have been paid fully to MDV.
1.10 In case of a default in payment, MDV is entitled to rescind and/or otherwise terminate the Agreement and the Customer shall be obliged to immediately surrender all delivered unpaid Products to MDV at the cost and expense of Customer, notwithstanding any right of MDV to claim all damages and costs in connection to such breach(es).
1.11 Selling on third party and marketplace platforms other than the client’s own website is strictly prohibited. The following commercial rules need to be abided to:
1.12 Customers with an annual spend of less than € 5,000 are required to place their POs via Faire.
1.13 Customers with an annual spend between € 5,000 and
€ 10,000:
1.13.1.A: Testers as part of regular order are subject to 10% extra discount. Only possible when ordering a minimum of 6pcs per SKU. So, if customers order 6pcs, they get 10% discount on the seventh.
1.13.2.B: Sachets only upon availability.
1.13.3.C: GWPs in consultation with the sales department pending approval by the commercial director.
RETURNS POLICY FOR PRODUCTS SUPPLIED BY MDV
1.14.A: Our commitment is to ensure your products arrive in perfect condition, and we are dedicated to promptly addressing and resolving any issues that may arise.
1.14.B: Returns are accepted only for faulty, damaged, or incorrect products. Quality defects include product leakage at the time of purchase, tearing from packaging, discoloration upon opening, or returns within the specified period with proof of purchase.
1.14.C: We cannot process returns for products with mold (indicative of improper use/cleaning/storage), cracks (resulting from long/sharp nails or improper use/storage), or used products.
1.14.D: To initiate a return, please contact info@mdveurope.com promptly, providing evidence such as proof of purchase, images, and a detailed description of the issue. MDV Europe will manage and facilitate a quarterly pick-up of returned products.

4. Special and/or sensitive personal data that we process
Our website and/or service does not intend to collect data about website visitors who are younger than 16 years of age. Unless they have permission from their parents or guardian. However, we cannot check whether a visitor is older than 16. We therefore advise
